PLEASE READ THESE TERMS OF SERVICE CAREFULLY (ESPECIALLY SECTION 6 “PAYMENTS AND REFUNDS”) BEFORE MAKING A PURCHASE.

Immediately after payment, you will gain instant access to your plan. Please follow the instructions provided after completing your payment.

1. AGREEMENT AND AMENDMENTS

1.1. These Terms and Conditions (the “Terms”) govern your relationship with “Chiselled Abs.”

1.2. Your use of the Service indicates your agreement to these Terms, creating a binding legal contract between you and “Chiselled Abs.” Therefore, PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICE. If you do not agree to all terms, you are prohibited from using the Service and must stop immediately.

2. DISCLAIMERS AND IMPORTANT INFORMATION

2.1. Medical and Healthcare Disclaimer: Chiselled Abs does NOT provide medical advice, health insurance, or healthcare services, including counseling, testing, evaluation, prescriptions, procedures, or therapies related to exercise, nutrition, weight loss, wellness, injury prevention, diagnosis, or treatment (“Healthcare Services”).

2.2. Suitability and Risks: The Service may not suit everyone and is not a substitute for professional healthcare. It’s meant as a helpful tool toward your health and fitness goals. You acknowledge that exercising involves risks, including injury or death, which you assume fully. Before using the Service, consult a healthcare professional to determine if it’s safe for you. You agree to release “Chiselled Abs” from any claims related to your use.

2.3. Medical Advice: Always seek advice from a qualified healthcare provider before starting any new exercise or diet regimen. If using the Service against medical advice or if health risks exist, you do so at your own risk. You accept full responsibility for your health and wellbeing, including that of your family and children (born and unborn).

2.4. No Medical Relationship: Accessing or using the Service does not establish a doctor-patient or healthcare professional relationship between you and “Chiselled Abs.”

2.5. Content Accuracy and Liability: We do not guarantee the accuracy of food recipes, exercises, or other content. Always verify information from manufacturers or professionals before using products or following advice. We are not responsible for health issues resulting from training programs, products, or information obtained via the Service.

2.6. Results and Testimonials: No guarantees are made regarding your success. Results vary based on individual effort, background, genetics, and commitment. Testimonials reflect exceptional outcomes and are not typical or guaranteed. Past results do not ensure future success, and maintaining results depends on continued effort.

2.7. Individual Responsibility: Your health and fitness progress depend on your dedication and circumstances. Use the Service at your discretion. “Chiselled Abs” is not liable for your success or failure.

2.8. Content Liability: We disclaim liability for inaccuracies or misstatements in content. Always consult your doctor or health professional before acting on any information from the Service.

3. USE AND AGE RESTRICTIONS

3.1. The Service is not intended for individuals under 16. By using the Service, you confirm you meet this age requirement. Minors must have parental permission and supervision. Minors’ parents or guardians should review and agree to these Terms on their behalf.

4. INTELLECTUAL PROPERTY AND MATERIALS

4.1. All text, images, logos, compilations, data, software, and materials on or related to the Service are proprietary to “Chiselled Abs.”

4.2. We reserve all rights, including intellectual property rights. Except as explicitly permitted, you may not copy, distribute, reverse engineer, or exploit this content.

4.3. Your use of the Service must comply with these restrictions and all applicable laws. You are responsible for any violations.

4.4. You are responsible for obtaining necessary equipment and internet services to access the Service.

4.5. Use of the Service is at your own risk. We are not responsible for damages, data loss, or harm resulting from your use.

4.6. Customer support is not guaranteed but may be provided at our discretion.

5. USER REPRESENTATIONS

By using the Service, you affirm that:

• You have the legal capacity and agree to these Terms.

• You are of legal age in your jurisdiction.

• You are not a minor unless supervised by a parent or guardian.

• You will not use automated means or engage in illegal activities.

6. PAYMENTS, SUBSCRIPTIONS, AND REFUNDS

6.1. Some features may require payment, which you can make through the website www.chiselledabs.com (“Purchase”).

6.2. We may change prices at any time, subject to applicable laws.

6.3. You authorize us to charge your provided payment method for purchases.

6.4. Payments can be made via accepted methods on the Service.

IMPORTANT: BY AGREEING TO THESE TERMS, YOU ACKNOWLEDGE THAT YOU ARE PURCHASING IMMEDIATELY DOWNLOADABLE PRODUCTS AND WAIVE YOUR 14-DAY CANCELLATION OR REFUND RIGHTS.  
6.5. Subscription Payments:
If you subscribe to a recurring monthly plan (“Subscription”), the subscription will automatically renew each month. Payment for each renewal is automatically debited from your chosen payment method unless you cancel the Subscription prior to the renewal date.

6.6. Initial Free Trial:
New Subscribers may be eligible for a 7-day free trial period. Payment will not be taken during this trial period. To continue with the Subscription after the free trial, your payment method will be charged automatically at the end of the trial unless you cancel before the trial concludes.

6.7. Payment Authorization:
By subscribing, you authorize “Chiselled Abs” to store your payment details securely and charge your payment method each month for the applicable subscription fee. Payment information may be stored securely on our payment processor’s platform, in accordance with applicable laws and our Privacy Policy.

6.8. Storing Payment Information:
We store your payment details securely for the purpose of recurring billing. You agree that we may retain and use this information for the duration of your subscription and for any renewal payments, unless you cancel your subscription.

6.9. Changes to Payment Terms:
We reserve the right to modify subscription prices or billing practices, but will notify you of material changes in advance. Continued use of the Service after changes constitutes your acceptance of the new terms.

6.10. Cancellation and Refunds:
You may cancel your subscription at any time via your account settings. Cancellations will take effect at the end of your current billing cycle.
IMPORTANT: As stated in Section 6.4, all purchases of downloadable products are final, and no refunds are provided for these.

6.11. Refunds for Downloadable Products:
We do not offer refunds for immediately downloadable products once purchased, as explicitly acknowledged in Section 6.4.

6.12. Important Note on Cancellation:
Cancelling your subscription before the end of the billing period will stop future payments, but you will retain access until the end of your current billing cycle.

7.1. We do not store or share your payment details or personal information with third parties, respecting your privacy and security.

8. CHANGES AND INTERRUPTIONS

8.1. We may modify, suspend, or discontinue the Service at any time without notice.

9. DISCLAIMER OF WARRANTIES

9.1. The Service and all materials are provided “as-is” and “as-available.” Use is at your own risk. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9.2. We do not guarantee the accuracy or completeness of content. We are not liable for errors, injuries, property damage, unauthorized access, viruses, or content issues.

9.3. The Service does not replace professional medical or legal advice. Always consult licensed professionals before acting on health or legal information. Exercises and diets may be dangerous if misused.

9.4. Downloaded material is at your own risk. We are not responsible for damages resulting from use.

9.5. To the extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data.

10. LIABILITY LIMITATION

10.1. We are not liable for damages arising from use of the Service, including lost profits, data, or other damages, even if advised.

10.2. Our total liability is limited to the amount you paid us in the six months prior or £100, whichever is less.

10.3. Claims must be brought individually, not as part of a class action.

10.4. Some laws may restrict these limitations; if so, some disclaimers may not apply to you.

11. INDEMNITY

11.1. You agree to defend and hold harmless “Chiselled Abs” and related parties from claims or damages arising from your use, breach of these Terms, or violation of third-party rights.

11.2. We may assume control of the defense at your expense and notify you of claims.

12. ELECTRONIC COMMUNICATIONS

12.1. Using the Service and submitting information constitutes consent to electronic communications, which satisfy legal writing requirements.

12.2. You agree to electronic signatures and records for transactions and notices.

12.3. You waive rights requiring original signatures or paper records.

13. GENERAL PROVISIONS

13.1. These Terms and related policies form the entire agreement. Failure to enforce any right does not waive it. Rights may be assigned. We are not responsible for delays beyond our control.

13.2. If any part is unlawful or unenforceable, it will be severed, and remaining provisions remain effective.

13.3. We may transfer rights and obligations to others, with your consent implied by continued use.

13.4. These Terms are drafted fairly and do not favor either party based on authorship.
